PWC of Davao: The Salary Saga Continues

Rank and file employees of the Philippine Women’s College of Davao have finally received their withheld salary on Thursday after protesting in front of the office of Gina Bequiso, an appointee of Mr. Emmanuel Canivel.
However, 36 administrators and middle managers have yet to receive their salary as Mr. Canivel, supposedly a self-proclaimed president, refuses to give the green light for the release of payroll lodged in a Metrobank account.
Affected employees said that they believe that Canivel has no right to withhold the release of their salaries. They shared that in their meeting with the mediator from the Department of Labor and Employment (DOLE) on Friday, 31 March, Mr. Canivel and his lawyer insisted on being furnished of the administrators’ payroll before it can be released. Such was a condition hard to swallow for the aggrieved personnel according to some of the complainants.
Infuriated employees stressed that Canivel’s assumption of the office of the PWC president is not recognized as its process of appointment remains questionable. They said “We do not recognize him as PWC president.”
Data privacy laws and professional ethics are some issues raised by the employees concerning the turnover of the details in the payroll. They fear that giving in to the demands of Canivel would legitimize his claim to the position.
It was cleared by the PWC representatives that if and when PWC provides Canivel with the payroll account, that does not legitimize his assumption as president. The team clarified with the DOLE mediator, who explained that it is a totally different matter since the main issue during the conciliation conference was simply the release of the withheld salaries and not his being president. The DOLE representative emphasized that it is outside of their jurisdiction and only the court can confirm the legitimacy of Canivel’s claim.
